10th International Conference on Malaysia-Indonesia Relations "Competition Law Enforcement in Indonesia and Malaysia: Cross-Border Challenges

This research analyses the challenge of anticompetitive cross-border conducts between Indonesia and Malaysia in the Perspectives of ASEAN Economic Community (AEC). The method uses in this study is normative and library-based study. When the AEC actively started in 2015, it required the ASEAN member countries to remove trade barriers and open their markets to other members so that they can entry the market freely. One of the consequences of the open market is cross-border anticompetitive behaviors. It is acknowledge that ASEAN has no multilateral regulation to avoid such behaviors nor bilateral agreement on anticompetitive cross-border conducts that violate national competition law. Some differences are available between both countries may challenge the cross-border enforcement by the competition law authorities. This paper suggest bilateral cooperation between both countries in the field of cross-border competition law enforcement to avoid extraterritorial jurisdiction conflicts.
